Shadowmire — User Agreement (End-User License Agreement)
Pre-release notice. Closed Beta pre-release draft. Shadowmire is currently in Closed Beta (Android internal testing; iOS and Steam to follow) and this Agreement is published on a development site for testing purposes only. It may change before public release. The version of this Agreement in effect at commercial launch is the binding one that governs your use of the released game. The final, binding versions of our legal documents — including the governing law, dispute-resolution terms, and complete legal-entity and representative details — will be published at public launch. If these documents ever conflict, the Terms of Service govern, then the User Agreement, with the Privacy Policy governing data matters.
This User Agreement ("Agreement") governs your download, installation, and play of Shadowmire, an Android-first Xianxia MMORPG published by Shadowmire Studio ("we", "us", "the Studio"). By installing or playing the game, you agree to these terms; if you do not agree, do not install or play.
1. Acceptance & Eligibility
By downloading, installing, accessing, or playing Shadowmire (the "Game"), you accept this Agreement between you and Shadowmire Studio. If you are entering into this Agreement on behalf of a minor as their parent or legal guardian, you accept it on their behalf and are responsible for their use of the Game.
The Game is not directed to children under 13, and we do not knowingly allow children under 13 to create an account (COPPA). Where your country sets a higher minimum digital age of consent, we enforce that higher age (for example, 13 to 16 under GDPR-K). Players below the applicable age of consent require verifiable consent from a parent or legal guardian before they may play.
We apply age-based feature bands to protect younger players. We collect your birthdate solely to determine your age band and enforce these rules; it is not used for any other purpose.
- Under 13: not eligible to create an account or play.
- Under 16 (where consent age is higher): restricted access, subject to regional rules and parental consent.
- 16 to 17: play permitted with verifiable parental or guardian consent.
- 18 and over: full access to all eligible features.
2. Your Account & Sign-In
Signing in with Google (Google Sign-In) is currently the way to create and access your account, and gives us your name, email address, and basic profile information via OpenID. Additional sign-in options are planned, including email or username and password, and linking an Apple or Facebook account; these are not yet available.
When password sign-in becomes available, passwords are stored only as a strong one-way hash (argon2id) and never in plain text, and you will be able to enable optional two-factor authentication (TOTP) with backup recovery codes. You are responsible for keeping your sign-in credentials, device, and recovery codes secure.
You are responsible for all activity under your account. Provide accurate information, keep it current, and do not share, sell, or transfer your account. Notify us promptly of any unauthorized use. We may refuse, reclaim, or reset a username or display name that is misleading, infringing, offensive, or that impersonates another party.
3. License to Play (Grant of License)
Subject to your compliance with this Agreement, the Studio grants you a limited, personal, non-exclusive, revocable, non-transferable, and non-sublicensable license to install and play the Game for your own personal, non-commercial entertainment on devices you own or control.
This is a license, not a sale. We reserve all rights not expressly granted to you. The license is granted only for as long as this Agreement remains in effect and may be suspended or revoked as described below.
4. Ownership & Intellectual Property
The Game and all of its content — including its software and code, art, characters, world, story, audio, user interface, and the "Shadowmire" name, logos, and marks — are owned by the Studio or its licensors and are protected by intellectual-property laws. Nothing in this Agreement transfers ownership of any of it to you.
You may not use the Studio's names, logos, or marks without our prior written permission. Any feedback, suggestions, or ideas you share with us about the Game may be used by us without restriction or obligation to you.
5. Virtual Items & In-Game Currency
The Game may include virtual items, cosmetics, and soft (in-game) currency. These are licensed to you for use within the Game only and remain part of the Game. They are not your property and have no real-world monetary value.
Shadowmire is not pay-to-win. Real money never buys combat power, stats, or any competitive gameplay advantage. Paid content is limited to cosmetics (which carry zero combat stats), convenience, and bound soft-currency.
- You receive a limited license to use virtual items and currency inside the Game; you do not own them.
- They have no cash value, are not redeemable for money, and cannot be exchanged for anything of real-world value.
- They are non-transferable and bound to your account; real-money trading, selling, or transferring items, currency, or accounts is prohibited.
- We may add, adjust, re-balance, expire, or remove virtual items and currency as the Game evolves.
- Virtual items and currency are forfeited, without refund, if your account is terminated or deleted, except where refunds are required by law.
- During Closed Beta, virtual items, currency, and purchases may be reset when a beta phase is wiped (see Section 9).
6. Purchases & Payments
Any purchases are processed through the applicable platform store (for example, Google Play) and are subject to that store's terms, billing, and refund policies in addition to this Agreement. What you receive for a purchase is the limited license to the corresponding virtual content described in Section 5 — cosmetics with no combat stats, convenience, or bound soft-currency only.
Because the Game is in Closed Beta, purchases and the content they unlock may be reset when a beta phase is wiped. Founder status and cosmetic honors are intended to persist across beta wipes, as described in Section 9. Please consider this before making any beta purchase.
7. Updates, Patches & Changes to the Game
Shadowmire is a live, online service that we actively develop. We may release updates, patches, and content changes, and we may add, modify, or discontinue features, systems, servers, or the Game as a whole. Some updates may be required in order to keep playing.
We aim to give reasonable notice of significant changes where practical, but as an evolving MMORPG the Game will change over time and specific content or features are not guaranteed to remain available.
8. Acceptable Use & Community Rules
You agree to play fairly, respect other players, and use the Game only for its intended purpose and in compliance with this Agreement and applicable law. In particular, you agree not to:
- Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Game, except to the extent this restriction is prohibited by law.
- Cheat, exploit bugs, or use bots, macros, automation, or unauthorized third-party software to gain an advantage or interfere with normal play.
- Datamine, scrape, or extract game data in order to exploit the Game, gain an unfair advantage, or circumvent security, anti-cheat, or content protections.
- Use the Game for any commercial purpose, or resell, rent, lease, sublicense, or engage in real-money trading of items, currency, or accounts.
- Disrupt, overload, or attempt to gain unauthorized access to the Game's servers, accounts, or infrastructure.
- Harass, threaten, defraud, or harm other players, or post or share hateful, illegal, or infringing content.
- Follow the in-game community rules and any additional guidelines we publish; we may update them from time to time.
9. Closed Beta — Provided "As Is"
The Game is currently offered as a Closed Beta (Android internal testing, with iOS and Steam planned later). Beta builds are pre-release, may be unstable, may contain bugs, and may change, be interrupted, or go offline at any time without notice.
Your data and progress may be wiped between beta phases. Where a wipe occurs, founder status and cosmetic honors are intended to persist. By participating in the Closed Beta you accept these conditions and understand the Game is provided "as is" for testing.
10. Privacy & Your Data
We process personal and gameplay data to operate the Game, secure your account, and improve the service. The categories we handle include:
- Account data: email, username, display name and tag, sign-in provider ID, and region or country.
- Age data: birthdate, used only for age-gating.
- Gameplay data: character, progress, settings, activity, in-game currency, and purchases.
- Device and technical data: device model, operating system, approximate region, IP address, crash logs, and performance metrics.
11. Email, Subprocessors & Selling of Data
We send transactional email — such as verification, security alerts, and important service messages — through our email provider (Resend). We do not sell your personal data.
We use a limited set of contract-bound service providers to run the Game, each on a need-to-know basis: hosting (Cloudflare Pages and DigitalOcean), Google (authentication), Resend (email), and crash and analytics providers. These providers may process data only as necessary to provide their service to us.
12. Your Privacy Rights
Depending on where you live, you have rights over your personal data under laws such as the GDPR and CCPA. These include the rights to access your data, correct it, delete it (erasure), export or receive a portable copy, restrict or object to certain processing, and withdraw consent.
To exercise any of these rights, contact us at privacy@shadowmire.studio. We will respond as required by applicable law.
13. Account Deletion
You can request deletion of your account today by emailing privacy@shadowmire.studio, or through in-game and support channels. Self-serve deletion will be available in the Game once the full account system launches.
When you delete your account, we remove your account and gameplay data. We retain limited financial and transaction records where the law requires (for example, tax and fraud prevention) and then anonymize them. Deletion requests are honored within 30 days. This process satisfies the Google Play data-deletion requirement.
14. Suspension & Termination
We may suspend or terminate your access to the Game or your account, in whole or in part, if you breach this Agreement or the community rules, cheat or commit fraud, harm other players or the service, or where required for legal or security reasons. Where reasonable and lawful, we will give notice, but serious or urgent cases may result in immediate action.
You may stop playing and delete your account at any time (see Section 13).
15. Effect of Termination
When this Agreement or your account ends, your license to play immediately terminates and you must stop using the Game and uninstall it. Virtual items and in-game currency are forfeited without refund, except where a refund is required by law.
Provisions that by their nature should survive termination — including ownership and intellectual property, virtual-item terms, disclaimers, limitation of liability, and governing law — continue to apply after termination.
16. Disclaimer of Warranties
To the maximum extent permitted by law, the Game is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Game will be uninterrupted, error-free, secure, or free from loss of data or progress, and this is especially true during Closed Beta.
Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions the exclusions apply only to the extent permitted, and you may have additional rights that this Agreement does not limit.
17. Limitation of Liability
To the maximum extent permitted by law, the Studio and its providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, progress, virtual items, or currency, arising out of or relating to the Game or this Agreement.
To the extent we are found liable, our total aggregate liability is limited to the greater of the amount you paid to us for the Game in the 12 months before the claim, or the minimum amount required by applicable law. Nothing in this Agreement excludes or limits liability that cannot be excluded or limited by law, including your mandatory consumer rights.
18. Governing Law & Disputes
This Agreement is governed by the laws of the jurisdiction in which the Studio is established, without regard to conflict-of-laws rules, and disputes will be handled by the courts of that jurisdiction. Because Shadowmire is in pre-release, the definitive governing-law jurisdiction and venue will be confirmed in the version of this Agreement in effect at commercial launch.
Nothing here removes the protection of any mandatory consumer-protection laws or the courts available to you in your country of residence where such rights cannot be waived.
19. Changes to This Agreement
We may update this Agreement from time to time as the Game develops and moves toward public release. When we make material changes, we will provide reasonable notice through the Game, our sites, or email. Your continued use of the Game after a change takes effect means you accept the updated Agreement; if you do not agree, stop playing and, if you wish, delete your account.
